Content Description

《制度经济学研究(总第28辑)(2010年第2期)》旨在借鉴犯罪经济学有关移民与犯罪的分析思路，对我国流动人口与犯罪问题进行深入研究。首先，本文不预设流动人口将导致犯罪的假设前提，而将其作为理论与实证分析的重要内容；其次，本文在犯罪经济学的理论框架下，结合我国流动人口在收入差距、刑罚威慑力、社会资本等方面的特征，对我国流动人口与刑事犯罪率的内在机理进行分析，提出相应的理论假说；最后，本文将利用1997-2007年全国31个省级面板数据从多维度对相关假说进行计量检验。

Book Abstract

把效率等同于掌控监督权和剩余索取权的主权者的效用最大化为前提，而被现代经济学赋予主权者角色的往往是社会上的强势者：相对于子女，父母是强者；相对于妇女，男人是强者；相对于黑人，白人是强者；相对于穷人，富人是强者；相对于工人，企业主是强者；相对于百姓，官员是强者；相对于少数，多数是强者。因此，子女、女性、黑人、穷人、工人、百姓以及少数都是父母、男人、白人、富人、企业主、。官员乃至多数为了获得效益最大化而可以任意配置的工具或投入品。在这种理论的指导下，企业效率就往往被等同于厂商的利润最大化，因而企业主可以不顾工人的工资下降和工作条件恶化，也不必考虑社会环境污染等社会成本；只要有利于资本积累的，就被认为是有效率的，这在某种程度上也正是国内那些“山寨厂”的竞争力之所在。同样，任何一个古代帝王或现代政客为了获得政治野心，可以平白牺牲无数人的生命，但这种政治体制也被认为是有效的，以至秦始皇、成吉思汗等人文治武功都可以被视为有效的证明，以至不断被一些人宣扬为千古英雄。④显然，现代经济学的效率分析主要是为强者行为提供理论基础，为现实社会制度辩护，将社会上的剥夺行为合理化；更为甚者，这种学说往往可以为社会中的各种歧视行为提供合理化的理论支持，从而有助于种族和种姓的社会等级制。事实上，按照现代主流经济学的理论，追求个人利益最大化可以有效解决歧视问题，而存在的歧视肯定符合社会的总体利益，因此不存在真正的歧视；正是基于这种意识，主流经济学认为，黑人之所以失业率高，根本上在于其自身的教育和能力问题，而不是社会问题。不过，充满讽刺的是，根据主流的博弈理论，我们又完全可以证明，基于市场行为多数派完全可以把少数派排除出市场而独享社会资源，因为歧视对少数一方造成的损害远远超过对多数一方造成的损害；这意味着，基于纯粹供求决定的市场本身是不规范的，而这种不规范的市场本身可以滋生出歧视问题。
