Book Abstract

（1）碳交易制度。目前国际碳交易主要基于排放上限与交易制、排放基线与信用交易制和排放抵补交易制。排放上限与交易制是指在确定一个国家或区域总量排放限额的基础上，对营运主体进一步分配排放限额，在营运主体实际减排的过程中与配额产生偏差，在碳市场交易的制度；排放基线与信用交易制是指基于每一减排主体主管机构事先确定排放基准，经过可核查的程序，实际减排量与基准排放量出现偏差而在碳市场交易的制度；排放抵补交易制是指针对新增设施或扩厂而增加的排放量，其新增排放需求应向既有排放者购买排放减量信用，以抵补其增加的排放量。整体来看，碳排放交易制度，包括交易主体、交易标的物、碳排放权的初始分配、碳排放权的权利移转、碳排放权交易监管机制及法律责任。

（2）减排项目融资制度。政府引导生态投资、鼓励民问开拓灵活的融资方式（基金、股票、信托等直接融资方式）并对项目融资复杂的法律关系制定配套的政策与法律法规及政策。

（3）碳保险。包括保险方式、保险责任的适用范围、碳保险责任免除、赔偿范围、保险费率、索赔时效和保险机构设置等。

（4）碳交易市场监管。包括主体资格审查制度、排污申报登记、排放物指标登记和排污指标交易登记制度、污染指标报告制度和交易追踪制度，以及排放监测能力、统计和信息公开制度。

（5）多元激励机制。例如美国二氧化硫排污权交易市场的“早期减排鼓励制度”，以税收减免或赠款的方式激励更多的机构及个人参与碳减排市场并积极引导企业进行碳信息披露。1．2．3国内碳金融法的立法现状1．2．3．1国内碳金融法的立法基础

1992年签署《联合国气候变化框架公约》以来，我国不断采取措施应对气候变化：2004年完成《气候变化初始国家信息通报》，并提交公约秘书处；2006年完成《气候变化国家评估报告》；2007年6月，中国政府正式发布了《中国应对气候变化国家方案》提出的中期减排目标，明确了到2010年中国应对气候变化的具体目标、基本原则、重点领域及其政策措施；同年公布了《中国应对气候变化科技专项行动》，以全面提升我国应对气候变化的科技能力；2008年8月，全国人民代表大会常务委员会颁布《关于积极应对气候变化的决议》；2009年11月25日国务院常务会议上，我国第一次以约束性指标的方式宣布，到2020年，中国单位GDP二氧化碳排放量将比2005年的下降400%～45％。我国处于工业化中期，40％～45％虽然不具有国际约束力，但是是具有法律约束力的国内自愿减排目标。
