钱颖一，生于北京，祖籍浙江。1977年考入清华大学数学系，1982年获学士学位。毕业后留学美国，分别于1982年获哥伦比亚大学统计学硕士学位，1984年获耶鲁大学运筹学/管理科学硕士学位，1990年获哈佛大学经济学博士学位。随后在美国的大学执教，现任伯克利加州大学经济系教授。研究领域包括比较制度经济学、转轨经济学以及中国的经济改革和发展。在国内外众多知名杂志期刊发表论文多篇。中文著作包括《转轨经济中的公司治理结构》和《走出误区：经济学家论说硅谷模式》。

钱颖一是我国留美学人中的一位十分关注中国经济改革、学有所成的经济学家。阅读他的这部论述中国经济改革问题的文集，不但可以从中领略现代经济学的魅力，而且可以看到一位身居异域的经济学家积极参与和推进中国经济改革的拳拳报国之心。
我初识钱颖一教授，是在1983年初。那时，许多中国经济改革的积极参加者深感学力不逮，纷纷到海外求学。我去了美国东海岸的耶鲁大学，追随比较经济体制学科（Comparatlve Economic Systems）的开创者之一蒙梯亚斯（J．M．Montias）研究东欧经济改革的理论和政策问
题。这时，颖一已经取得了哥伦比亚大学的统计学硕士学位，正在耶鲁大学管理学院攻读管理科学和运筹学的学位。从那时起，我们保持了20年的友谊，有过许多交流和合作。1984年7月，我从耶鲁大学回国，从事为经济改革服务的咨询研究工作。颖一则从耶鲁到哈佛大学经济系

书所收集的论文中我们可以看到作者如何像庖丁解牛那样熟练地运用现代经济学的研究视角、分析基准和分析工具剖析中国转轨中的问题，对纠缠难解的问题给出言之成理、持之有故的回答。在掌握和运用现代经济学的分析框架的问题上，颖一特别强调掌握阿罗德布鲁定理（Arrow Debreu Theorem）一类分析基准的重要性。对于国内的研究者来说，这是一个切中时弊的提示。由于小农社会的历史背景，加之多年以“反教条主义”为名的反理论思维灌输，在这个问题上，无论在学术界还是社会上都存在巨大的认识误区。正像颖一在这篇文章中说到的，对于现代经济学中的这些基本定理有两种常见的误解：一种是以为理论描述与现实世界完全相同，因此将它们到处套用；另一种是因为理论与现实存在差距而认定它们都是胡言乱语，毫无用处。这两种情况在我们这里几乎随处可见。以阿罗一德布鲁定理来说，就存在这样两种截然相反的观点：一种是把阿罗一德布鲁定理简单套用到改革的实际工作中去，认为只要放开了市场（比如说资本市场），而不论它是什么样的市场和处在什么样的监管环境之下，稀缺资源（比如说资本资源）都会自然而然地得到最优的配置。而当发现生活中的现实并不如此简单的时候，有些人又走向了另一极端，他们不去研究阿罗一德布鲁一般均衡模型的限制性假设（如信息的完全性和对称性），而是断言必须“彻底否定”一般均衡理论等现代经济学的基本理论，另外创造一套“全新的”理论体系去分析中国的经济问题；或者主张干脆抛弃任何理论思维，“有什么问题解决什么问题”。无论对于现代经济学的基本理论持有哪种错误的观点，都会导致全盘否定理论经济学存在的必要性和提倡实际工作的盲目性，给改革造成很大的危害。在将近半个世纪的中国改革历程中，我们已经为此付出了过多的代价。

Book Abstract

第二类情况是限制政府任意权力的法律太少。在计划经济时代，政府说什么就是什么，政府的任意权力是无限的。现在虽然强调法治了，但是限制政府任意权力的法律还远远不够。政府的任意权力反映在各个方面。比如企业建起来以后，各种骚扰、摊派、赞助等就蜂拥而至，没有法律约束政府的这些权力。又比如执法是运动式的，像查偷税漏税，是搞运动式的，没有法律程序约束这种执法。再以2002年底中国电信凋价为例。先是突然调高海外接入价格，然后迫于压力又调低价格。它说明政府监管部门的电信定价没有程序上的约束，政府任意权过大，想干嘛就干嘛。实际上的结果是政府的监管部门被电信公司“俘获”，企业的目标成为了政府的目标，又没有法律约束政府的任意权力，结果政府的调价决定造成了市场的无序。
政府的滥用权力引起人们预期政府的政策多变，非常不利于经济的发展。如果是一个法治环境，就有认定的程序。比如电信价格属于被政府规制的价格，调整时就需要举行听证会，就会有公众的声音，并不是仅仅是电信公司的游说。法治中非常强调的程序的作用就是对政府任意权力的限制，政府做事的时候必须遵循一定的规则，不能随便行事。但是，目前我国限制政府任意权力的法律欠缺，比如，迄今为止尚未出台约束行政垄断权力，保障公平、透明决策的《行政程序法》。因此，调查程序、听证程序和决策程序都无法可依。
这两类情况，一个是政府给经济人加过多的约束，一个是对政府的任意权力约束不够。它们都会干扰有限政府的实现，不利于好的市场经济的形成。将这两类问题区分开来是有意义的，因为它们的表现形式不一样，但是都反映了法治在约束政府方面的偏差。由于我们国家原有的法律很少，因此，就有一种自然倾向，似乎法律越多越好。事实上，这正是法治建设中容易出偏差的地方。法律太多已经成为许多市场经济发展的制度性障碍。中国也面临这样的危险，从法律不健全会走向颁布法律过多。中国要警惕可能走上拉美、印度的老路。但在约束经济人的法律过多的同时，约束政府任意权力的法律却很不够。因此，政府对经济发展的不利影响往往是双重的：一方面是法律太多的弊端，使政府干预有了法律的依据，对企业生存和发展造成困难；另一方面是政府做事可以不按程序，干预的任意性仍然很大。
法律太多和政府干预的任意性是偏离有限政府的两个方面，虽然表现形式不同，但是都反映了同一种根本性的观念误区。这个误区就是把法律作为政府管理经济的工具，即法律的“政府工具论”。这种法律的政府工具论的观念是普遍存在的，它是出现政府违背法制的两类情况的根源。法律不是政府的工具，政府往往成为法律的障碍，法治的实质是政府和经济人都受法律的约束。因此，只有彻底改变法律的政府工具论的观念，才能使政府成为真正的有限政府，才能建成真正的法治。
六、有效政府与政府监管
在法治国家，政府的行为受到法律的约束。在此条件下，政府如何成为有效政府，是能否建立一个好的市场经济的重要因素。
产权保护和合同实施是经济学家一致认同的政府职责。除此以外，对经济人在市场中的行为要不要有所“监管”(regulation)，则有不同声音。“regulation”这个词中文有多种译法——规制、监管、管制、控制、干预等等。在产品市场的场合(比如电信)，常翻译成“规制”；在金融市场的场合，常用“监管”；在劳动力市场上，常用“管制”。 “控制”和“干预”也是常用的翻译。
对要不要监管这一问题，三种观察政府和经济人的视角有三种不同的回答和建议。依照“善政府，恶经济人”的视角，市场中的经济人的行为需要广泛被约束，因此政府要大力监管，监管会提高社会福利。而具有“恶政府，善经济人”视角的人则持相对立的回答和建议。在他们看来，政府监管是为了制造障碍以便向经济人索取好处，即“寻租”的表现。出于自利而非为公的动机，政府总是倾向于过度监管，但实际结果却是无效监管：政府被监管者“俘获”，依照后者的意愿“监管”，结果并不是提高社会福利。另一方面，他们相信没有政府出面约束，市场自然会令经济人自己做到行为规范。因此，他们的建议通常都是政府监管越少越好，甚至不要监管。
第三种视角“恶政府，恶经济人”认为，有些时候约束经济人的行为仅仅靠保护产权和实施合同是不够的。比如，在产品市场中，维持竞争秩序和保护消费者权益(比如产品安全性)需要对生产者有所约束。在金融市场上，保护投资者的权益也需要对用资者有所约束。在这种情形下政府监管有潜在的收益。在这一点上，第三种视角与第一种视角有相同之处。另一方面，第三种视角与第二种视角也有共同之处，那就是对政府行为出发点的怀疑。“过度监管”和监管者被“俘获”都说明政府并没有在为人民谋利益。因此具有这种视角的人并不建议监管越多越好，主张具体情况甄别对待。只有当监管的成本(重要成本之一是来自政府失灵的成本)小于监管的收益时，监管才有意义。因此，对监管者——政府——要有约束，有效政府只有在有限政府的条件下才能实现。
第一种视角和第二种视角的共同性是不区别市场和情况，一概提倡大力加强监管或削弱监管。第三种视角则不同，主张适当监管，而监管内容在不同市场针对不同问题。在产品市场上，监管的重要内容之一是建立和维护竞争秩序，比如在电信、航空等产业。起初，人们想到的是简单的反垄断。现在经济学家开始在“对垄断的规制”的说法上有一个转变，因为规制很容易让人误解为干预，而且这样的说法比较静态。现在更多地是说政府实施“竞争政策”(competition policy)。这是一个更向前看的说法，更多强调的是促进市场竞争。从促进竞争这个角度来讲，可以面向未来，考虑到将来的技术变化，持一种开放的态度。
金融市场的监管情况就不同。那里的问题主要是如何通过监管让公司和金融机构(后者包括银行、基金、券商、保险公司)的经理把“圈来的钱”掏出来还给投资者。针对的是约束不情愿把掌握在自己手里的钱还给投资者的经理。经理以圈钱、掏空和欺诈行为对待投资者是一种天性。除非他有其他的制约，不然都这样，全世界都一样。对金融市场的经验研究表明，在没有政府监管的情况下，金融市场的发展并不成功。比如在90年代，捷克金融市场的发展就远不如波兰的成功，而捷克政府奉行的正是不监管的政策。政府的适当监管，比如强制信息披露和限制关联交易，对发展金融市场有促进作用。
在现实中，政府监管在任何国家都不是或者是零或者是一。即使在发达国家，在两者之间也在不断作出微调， “钟摆”在一个时期向加强监管摆动，另一个时期则向放松监管摆动。20世纪八九十年代，钟摆向放松监管的方向摆动，这是因为70年代的政府管制过头了，压抑了经济的发展。进入21世纪后，钟摆又有点往回摆了，原因在于发现了一系列的问题，包括公司治理结构的问题、会计问题、电力市场问题等等。这些问题说明我们不能假定政府退出以后市场就可以自动解决问题，一个有效且有限的政府在此至关重要。
