阿奎那对第一个问题——即以高于物品本身价值的价格出售该物品是否合法——的深入思考很好地证明了他的思考模式，证明他强调的是道德伦理而不是解析式的论据。既然民法认可了人口交易的合法性，那么以高于物品本身价值的价格出售该物品就是合法的。所有人都司空见惯的事仿佛就是合理的、无罪的，如果每个人都认可了“贱买贵卖”的格言，那么以高于物品本身价值的价格出售该物品或者以低于物品价值的价格购买该物品这些行为都是合法的。然而，圣经箴言与此相反——“己所不欲，勿施于人”。这样，阿奎那得出结论：以高于物品公平价格的价格出售该物品，这样的欺诈行为完全是不合法的。
