《特殊儿童教育与康复文库：残疾儿童权利与保障》：
残疾儿童康复权也是当前我国法律明确规定的一项重要权利。我国1991年颁布实施，2006年修订的《未成年人保护法》虽然没有明确指出残疾儿童享有康复服务的权利，但在家庭保护条款中明确规定：父母或者其他监护人应当创造良好、和睦的家庭环境，依法履行对未成年人的监护职责和抚养义务。不得歧视有残疾的未成年人。在社会保护条款中明确了卫生部门和学校应当对未成年人进行卫生保健和营养指导，提供必要的卫生保健条件，做好疾病预防工作，体现了未成年人应该享有医疗保健权。基于该法规定，保护未成年人的工作应当遵循适应未成年人身心发展的规律和特点原则，因此，实际上该法隐含了残疾儿童享有特别的医疗保健内容。而我国1991年制定，2008年修订的《残疾人保障法》第15条非常明确地规定了国家保障残疾人享有康复服务的权利。各级人民政府和有关部门应当采取措施，为残疾人康复创造条件，建立和完善残疾人康复服务体系，并分阶段实施重点康复项目，帮助残疾人恢复或者补偿功能，增强其参与社会生活的能力。第16条明确要求优先开展残疾儿童抢救性治疗和康复。可见，残疾儿童作为残疾人群体中一类需要特别关注的群体，应该优先享有康复服务的权利已经在我国法律中得以明确。
基于国际法和国内法就残疾儿童康复相关权利的规定以及当前国内外为残疾儿童提供康复服务的主要实践，研究者认为，通过物理的、生理的、医学的、教育的、职业的手段都可以从不同方面对残疾儿童的身心康复产生显著影响，因此，广义的残疾儿童康复，可以依据为残疾儿童提供的康复手段分为医疗康复、教育康复、职业康复、社会康复等，残疾儿童康复权内容可以从身体、个体和环境三个方面展开。由于《特殊儿童教育与康复文库：残疾儿童权利与保障》后面还会重点讨论残疾儿童财产权、受教育权和社会参与权等内容，为避免内容重合，本章仅从狭义的医疗康复层面出发，重点探讨身体、个体和环境方面的残疾儿童康复权，将残疾儿童康复权界定为：基于残疾儿童的发展特性，作为个人或群体的残疾儿童获得、享有经科学诊断、评估之后的医学治疗与康复训练、心理咨询与治疗、辅助器具支持等服务，以最大限度恢复生理和心理机能，提升参与日常社会生活能力的权利。
残疾儿童康复权是残疾儿童生命权和健康权的重要内容，该权利是残疾儿童除了享有其他普通儿童普遍享有的共同权利外，还特别享有的基于身体机能、智能处于不利境地而得到的某些倾斜性、优惠性的特殊权利。残疾儿童康复权是人类社会发展到一定阶段赋予残疾儿童特别保护的权利之一，以享有康复服务为核心。当前社会提供的康复服务内容主要包括医学服务、心理服务、辅助技术应用等，但伴随着人们对康复认识和理念的演进，康复服务内容会不断地发展变化，残疾儿童康复权概念也会不断发展和演变。
我国残疾儿童康复权的权利主体是各类残疾儿童个体及其群体，包括视力残疾儿童、听力残疾儿童、言语残疾儿童、肢体残疾儿童、智力残疾儿童、精神残疾儿童和多重残疾儿童等，义务主体则主要为各级人民政府、社会和残疾儿童家庭。保障残疾儿童实现康复权的目标是促进他们的生理和心理功能恢复到尽可能好的水平，以便在身体、心理等方面最大限度地正常发育成长，享有普通公民应有的各项权利。二、残疾儿童康复权的主要内容残疾儿童有别于普通儿童的特征是其心理、生理、人体结构上，某种组织、功能丧失或者不正常，全部或者部分丧失以正常方式从事某种活动的能力。从我国相关法律对残疾儿童的主要功能障碍界定而言，残疾儿童康复可以分为专门针对视力残疾儿童、听力残疾儿童、言语残疾儿童、肢体残疾儿童、智力残疾儿童、精神残疾儿童和多重残疾儿童等不同类别残疾儿童的康复；从我国相关法律对残疾康复保障内容而言，残疾儿童康复权主要包括获得残疾诊断与医学治疗、功能康复训练、辅助器具验配、心理康复和康复救助等五个方面的权利。
