Author Description

马险峰，陕西礼泉人，现任中证金融研究院副院长。1987年在西安参加工作，1996年在中国社会科学院研究生院获经济学博士学位，1996年至1998年在北京大学经济学院从事博士后研究工作。曾受派赴英国金融服务监管局工作，任大连商品交易所总经济师等职。长期从事中国证券期货市场政策研究和发展规划工作。

《资本市场：现代金融的核心》：
（2）限制商业银行从事某些高风险业务，限制其从事与客户服务不相关的自营交易，投资于对冲基金和股权投资基金中的权益不超过一级资本的3%。
（3）加强对场外衍生产品交易的监管，规定美国证券交易委员会和美国期货交易委员会共同负责场外市场监管，建立中央清算制度并逐步将有条件的产品转移到交易所市场，要求商业银行将部分业务剥离到资本充足的子公司等。
（4）加强对信用评级机构的监管，要求在美国证券交易委员会内部新设评级机构监管部，加强对评级机构的日常监管，做好年检工作，对严重违规的机构有权撤销其注册资格等。
（5）强化对对冲基金和私募股权基金的监管，要求管理资产超过1亿美元的基金管理机构须在美国证券交易委员会注册，并提供交易和投资组合的相关信息。美国证券交易委员会要对注册机构进行定期检查并每年向国会报告，以确保在加强监管的同时不影响其灵活性。
3.加强对投资者和金融消费的保护
（1）加强对证券化产品的监管，在确保其积极发挥功能的同时，降低风险水平。
（2）完善上市公司治理和增加高管薪酬透明度。
（3）加强资本市场监管，扩大美国证券交易委员会和美国期货交易委员会的监管职责和经费预算，规定这两家监管机构共制定新规则157项，占法案涉及243项新规则的64.6%。
（4）要求在美联储内部设立消费金融保护局，负责所有面向消费者的金融产品的监管，避免消费者在购买金融产品时受隐性费用、欺骗性条款和欺诈行为的损害。
金融危机是通过破坏性的强制作用来校正金融制度的缺陷，推动金融制度的完善与资源配置的优化。据统计，过去160多年来，全球几乎每年都在一定范围内发生金融危机。因此，对一个国家的发展来说，能够做到的是在尽可能避免危机的同时，更要制定预案应对危机。对我国来说，防范和避免危机，保持金融、经济的繁荣与稳定，具有非常重要的意义。“十二五”乃至未来20年，是我国全面建成小康社会并向中等发达国家迈进的关键时期。在这一阶段，传统计划经济因素会逐步减少，市场经济因素特别是金融市场会逐步扩大，与金融市场因素发展相适应的金融监管应不断加强。对此，各方应进一步提高认识，加大相关制度的创新力度，确保金融监管力量的增加能够跟上市场发展的步伐，以切实防范和避免金融危机的发生，服务实体经济可持续发展。
