Book Abstract

一、面临形势
（一）医药卫生监管面临更加复杂的困境
一表现为重大环境卫生和食品安全事件频繁发生。例如，北江镉污染事件、广州毒酒事件、苏丹红事件、含三聚腈氨奶粉事件。二表现为职业病和重大传染病防控形势严峻。2002年以来，先后发生了惠州超霸电池厂镉中毒事件、佛山皓昕五金首饰有限公司尘肺病等重大职业病危害事件，发生了如“非典”、人禽流感、手足口病等突发传染病疫情。三表现为非法行医屡禁不止，非法医疗广告屡禁不止，血液安全监管仍存在重大压力。
当前出现的这些医疗卫生问题，是一种严重的社会问题，表面上或呈现为利益驱动的结果，或呈现为环境污染导致，但其背后却有深厚文化、制度和管理方面的原因。要打破这种困境，其中重要工作之一就要按照党的十七届二中全会精神，进一步深化行政管理体制改革，建立起科学的卫生监督体制。
（二）监督队伍生存和发展面临前所未有的困难
一是卫生监督机构面临生存困境。调查结果显示，自2000年改革以来，卫生监督机构为民生存和发展，在财政投人不足之下，其服务收入是逐年增加的。2006年，平均每个县级卫生监督机构服务收入占机构总经费的20.61％，收入主要来自餐饮消费行业从事人员培训和体检。另一方面，卫生监督机构负债额亦逐年增加，市、县两级负债率年增长速度分别达到30.35％和51.19％。2006年，平均每个县级卫生监督机构负债额达58.1万元。这说明，卫生监督机构生存环境并未得到根本改善，它必须依赖服务收入来维持其日常运作。2008年，随着食品安全监管体制改革实施，餐饮消费划出卫生部门后，卫生监督机构将失去绝大部分服务收入，其生产将面临极大困难。
二是卫生监督机构发展方面不定。随着地方政府机构改革方案的实施，食品安全、职业卫生监管等职能改革调整，在决策权、执行权、监督权三权分离的行政管理架构中，卫生监督机构应当承担哪类职责？这些深层次问题如果得不到明确，必将影响卫生监督机构未来的发展。

Introduction

卫生监督是国家管理社会公共卫生事务的重要形式和手段，是社会卫生管理的基本法律制度。它的基本任务是保障市场经济和各种社会活动中的正常卫生秩序，预防和控制疾病的发生与流行，保护公民的健康权益。如何更好地发挥卫生监督功能和作用，卫生监督体制构建是否科学是关键。
1997年，中共中央国务院颁布了《卫生改革与发展的决定》，提出卫生工作的奋斗目标是，到2000年初步建立具有中国特色的包括卫生服务、医疗保障、卫生执法监督的卫生体系。2000年，卫生部印发《关于卫生监督体制改革的意见》，明确按照政事分开和精简、效能、统一的原则，建立起办事高效、运转协调、行为规范的卫生监督体制，真正开启了以行政执法为核心的卫生监督体制改革序幕。同年12月，广东省卫生监督所挂牌成立，标志着广东卫生监督改革之路全面铺开。2003年，中共广东省委、省政府在取得“非典”战役阶段性胜利后，提出要用3年时间，完善包括卫生监督体系在内的公共卫生体系，进一步提高医疗卫生应急处置能力。自此，广东卫生监督体系步入重要建设时期。十年铸一剑，目前，广东省已基本建立起了省、市、县三级卫生监督网络，卫生综合执法能力得到了显著提高。
然而，随着实践的深人，2000年国家推行建立的卫生监督体制所隐含的问题逐渐显露，如监督体系缺乏法律支撑、机构性质不明、职责不清等，这些问题严重制约了卫生监督事业顺利发展，进一步深化卫生监督体制改革势在必行！
2009年，《中共中央国务院关于深化医药卫生体制改革的意见》、《食品安全法》相继发布和实施，省政府机构改革全面启动。卫生监督迎来职能重大调整和体制改革的关键时刻。因应时势，广东省卫生厅联合中山大学公共卫生学院，及时成立广东省卫生监督体制改革研究小组，以推动卫生监督体制改革与发展为宗旨，通过深入、广泛调研，借鉴国内外先进经验，编写了《广东省卫生监督体制改革研究报告》。
本书分四部分。第一部分通过对广东省卫生监督体系2002-2006年建设情况分析，总结成功经验并指出存在的问题。第二部分阐述当前形势和机遇。
