附录二司法实践中的微表情分析
微表情在司法调查中的应用主要是现场测试。其中测试问题的设置、切入点、提问时机等非常重要，是测试成败的关键。在实践中，测试的对象可能是无辜者，也有可能是真正的作案人。测试与审讯不同，不仅要测试个体对于案件相关问题陈述的真伪，其有无涉案，是否可能是真正的作案人等，还要为审讯工作留有余地，不能轻易暴露调查人员所掌握的证据，不可漏“底牌”，以免使后期的调查工作陷入被动。
因此，测试者的首要任务是确定被试是否可能涉案，是否是真正的作案人。同时，通过微表情测试获取关于被试尽可能多的信息，为审讯及案件调查工作提供参考意见。
司法调查中用到微表情测试，往往是因为根据调查被试可能涉案，但是缺少证据证实，也难以排除其与案件相关的可能性，只能从被试的陈述内容中获取线索。主要分为两种情形：①被试表面上与案件没有任何关联，但其又有作案的可能条件，如技能、作案时间、作案动机等；②被试本身就与案件存在关联性，如目击者、知情者等，甚至是某种程度的参与者，但无法确定其陈述内容的真实性及是否为真正的作案人。
一、问题设置及测试前的准备
（一）问题设置
对于调查中尚不明确被试是否与案件有关的情形，测试时可以参考以下问题的设置。但这些问题的设置并不适用于被试本身就与案件有关的情形，提问可分为两组。
（二）第一组问题
1提问
主要包括：①叫什么名字？②什么地方人？③知道什么事吗？
这一组问题非常关键，运用得恰当，测试结果的准确率可在70%以上。其中①、②为基准测试问题，用于确定被试回答问题时的回答间隔、音调、音量、面部微表情、肢体微动作等。重点问题是③。
2回答
被试对于问题③的回答，通常分为两种情况：一是“知道”；二是“不知道”。两种不同的回答内容，可能表达了对方内心不同的情绪情感及想法等。
（1）回答“知道”
当被试回答“知道”，且与回答①、②两个问题时的基准线一致时，表明其陈述内容的真实性高。因为前两个问题一般与案件无关，被试往往都能如实回答，也几乎无需思考。而对于问题③，只要被试出现任何的思考、内心冲突，存在任何的情绪、心理波动、其他想法等，回答间隔就会明显拉长，音量、音调及面部表情也可能会发生变化。
一般当被试快速地回答“知道”时，其撒谎的可能性较小。对于回答“知道”的被试，可以紧接着问：“什么事？”进一步观察对方的反应。如果是被试“顺口”回答的“知道”，那么其在回答具体事情的时候，很可能会出现回答间隔长，内容含混不清，拖延等表现；而当对方真“知道”时，通常回答具体事情的速度也较快，与问题①、②、③的回答间隔、音调、音量、面部表情等身体表现基本一致。
被试回答“知道”，并且能够快速回答“具体事情”，假如对方真是一名撒谎者，那么其可能会在案件的关键细节上撒谎；或者对方撒谎的技术和心理素质都很过硬，很可能受过特殊训练或者其是提前准备好答案的高智商撒谎者。
（2）回答“不知道”
被试回答“不知道”时的情况较为复杂。如果这是被试第一次测试，之前其没有接受过任何的调查，那么其回答“不知道”时，撒谎和真实回答的可能性都存在。
若被试的确与案件相关，其回答“不知道”前可能会出现明显的停顿、思考，回答间隔较长等；或者被试可能存在其他违法犯罪的事情，而并不一定与所调查的案件相关。
无辜者或者涉及其他案件的被试在回答完“不知道”后，一般都可能会直接向测试者了解情况，如“我到底因为什么事情？”不同的是，无辜者可能会出现疑惑甚至愤怒的微表情；而涉及其他案件的被试往往可能会面带笑容，试探性地问测试者，语气和语调较为平和。如果被试与案件相关，其回答完“不知道”后，可能会有相对长时间的低头、沉默、抿嘴等表情动作。
如果被试已经经过了多次的调查，其明显知道自己可能涉及的事情，而在测试时问其“知道什么事吗？”其却回答“不知道”或直接沉默，排除前期调查中的不当方法激怒了被害人，表明其很可能与案件相关。
（三）第二组问题
1提问
其主要包括：①年龄？②家里几口人？③都是谁？④某人的年龄、生日？⑤某日（与案件无关）你在哪？做什么？⑥某日（与案件有关）你在哪？做什么？⑦倒叙？
2回答
第二组问题是在第一组问题之后的继续测试。通过问题①、②、③、④，了解被试的基本情况。问题④是为了让被试尽可能地去思考、回忆，如被试的配偶、孩子的生日、兄弟姐妹的年龄等，可以多问几个对方熟悉的人的年龄、生日，获取其对日期及数字思考、回忆时的眼动基准。问题⑤是为获得被试对于情景记忆的眼动特征，如昨天的某时对方在哪？在做什么？选取近期的，与案件无关的时间问对方，获取对方回忆时的眼动基准后，再问被试几个时间点远些的问题，目的是获取对方回答不出来时的回答间隔、眼动基准等。
前五个问题主要与案件无关，不论被试是否涉案，一般对方都能如实回答，其也不会太防备，此时在其回答这些问题的过程中，获取对方的微表情基准，尤其是眼动特征。另外，前五个问题还有一个重要作用，即被试在思考、回忆问题的答案时往往会分散注意力，身心也会相对放松，有助于测试真正的问题⑥、⑦。问题⑤为问题⑥做好铺垫后，进行问题⑥。不论对方是“记得”还是“不记得”，都可以与其在问题⑤中的表现对比，确定其是否在撒谎。如果对方能快速详细地回答出问题⑥时，可继续问题⑦。当对方能够顺利倒叙时，表明其陈述内容的可靠性较高，但也不能完全排除其精心准备答案和反测试的可能性。
通过以上两组问题，可以对被试的智力水平、语言组织能力、个性特征等作一初步评估，为深入测试打下基础。在实践中，没有两个完全相同的案例，也没有两个一样的被试，更没有不变的测试方法和技巧，问题的设置需要根据被试的个人情况、案件内容及测试时对方的表现不断调整，以易获取对方面对刺激时的真实情绪情感为目标。
（四）测试前的准备
一般在司法调查中，进行测试前，首先需要了解三个基本问题：①案件情况，尤其是有关案件发生的细节；②被试的背景资料，包括个人情况、家庭关系、成长经历等，特别是影响其人生的重大事件；③前期的调查情况，包括专家意见、痕迹物证的鉴定情况及调查部门所开展的具体工作等。
