Author Description

罗大华，教授，福建省武平县人。1955年7月毕业于福建省长汀师范学校后，从事小学教育工作1年。1956年9月至1960年7月就学于上海华东师范大学教育系，1960年8月分配到北京政法学院（即中国政法大学前身）任教至今。1990年12月晋升为教授。新中国犯罪心理学科主要创始人之一。多年从事犯罪心理学、刑事司法心理学、证言心理学、罪犯矫治心理学等学科的研究与教学工作。主要著作有：《犯罪心理学》、《法制心理学词典》、《司法心理学》、《罪犯改造心理学》、《证人证言心理》等。现任中国政法大学犯罪心理学研究中心主任，硕士研究生导师，兼任中国心理学会常务理事、法制心理专业委员会主任，中国犯罪学研究会常务理事、犯罪与矫治心理学专业委员会主任，中国社会心理学会常务理事，中国家庭教育学会常务理事，中国警察学会学术委员会委员，北京市社会心理学会常务理事，北京市关心青少年教育协会常务理事，北京市心理卫生协会理事，北京市法学会理事，北京市监狱学会顾问。《检察日报》等报刊介绍过其事迹。1992年享受国务院政府特殊津贴。其传略被辑入《法律心理学大词典》、《中华法学大辞典》、《中国当代教育名人大辞典》等辞书。

司法活动的范围十分广泛，包括刑事、民事、经济、行政等领域的司法活动，以及律师、公证、人民调解等司法行政活动，其中，刑事司法和民事司法是司法活动的主要方面。本书主要探讨刑事司法活动和民事司法活动中基本的心理学问题，既要探讨它们的共同性问题，又要分别探讨各自的特殊性问题。本章作为导论，将阐明司法心理学的研究对象、任务、学科性质、地位及与有关学科的关系，阐述司法心理学的研究原则和方法，介绍西方和我国司法心理学的发展概况。
第一节 司法心理学的研究对象和任务
一、司法心理学的概念
什么是司法心理学（judicial psychology或forensic psycholo—gy）?不同的学者对它的定义并不相同。康诺利和麦凯勒（K.Connolly&P.Mckellar，1963）把司法心理学定义为心理学在法庭诉讼程序、警察调查和有关事务中的应用，强调在法律领域对行为的研究。巴托尔夫妇、（C.R.Bartol＆A.M.Bartol，1999）认为，司法心理学是指考察直接与法律过程（如证人记忆和证人证言、陪审团决策或者犯罪行为）有关的人类行为的研究活动，以及围绕刑法、民法和大量交叉领域中的法律制度而进行的心理学专门实践。因此，在广义上，司法心理学指心理学知识在民事和刑事司法领域的应用及其产物。赖茨曼（L.S.Wrightsman，2000）认为，司法心理学是心理学知识或方法在法律系统面临的任务中的应用。林崇德等主编的《心理学大辞典》认为，司法心理学是指法制心理学体系中研究司法活动过程中有关人员的心理活动及其规律的分支学科群的总称。
