（三）我国刑事诉讼中走私犯罪嫌疑人诉讼权利的完善
尊重人权是一项重要的国际法原则，20世纪特别是第二次世界大战以后，人权保障问题成为日益国际化的问题，各国都十分关注这一问题。《世界人权宣言》第十一条规定：凡受刑事指控者，在未获得公开审判而依法证实有罪以前有权被视为无罪。我国政府1998年10月签署加入的联合国《公民权利和政治权利国际公约》对犯罪嫌疑人人权保障所确立的主要原则和内容有：在法庭和裁判面前人人平等；有权要求组成独立的、不偏袒的审判庭进行公平、公正的审判；无罪推定；有权立即知悉逮捕原因并应被及时审判；不得强迫自证其罪；禁止酷刑或施以残忍的、不人道的或侮辱性的待遇或刑罚；有权自行辩护和获得律师辩护；控辩双方证人出庭作证并接受询问和质证；错案有权获得赔偿；一事不再理等。我国修改后的《刑事诉讼法》在保护人权方面取得了明显的进展，大体上接近国际标准，但与国际标准还存在一些差距，应当进一步完善，这些完善也同样适用于走私犯罪嫌疑人。
1.应当赋予走私犯罪嫌疑人反对强迫自证其罪的权利
在国际上反对强迫自证其罪作为刑事司法公正的标准，通常被视为一项权利或特权，往往被称为“反对自证其罪的权利”或者“反对自证其罪的特权”。狭义上的反对自证其罪的含义是不得以暴力或利诱等方法迫使犯罪嫌疑人自证其罪；而广义上的含义还包括为了确保反对自证其罪的实现赋予了犯罪嫌疑人以沉默权。目前，英美国家通过赋予被告人沉默权来避免一种“残酷的选择”，这种“残酷的选择”是指在美国联邦最高法院的判例中所体现出来的三种选择：一是在法庭上经过了宣誓以后再作出伪证，这种情况下是要受到伪证罪的处罚；二是宣誓后的沉默行为是要受到藐视法庭罪的处罚：三是如果如实地供述了自己的罪行，就要受到所指控的罪行的处罚。英美国家认为尊重人权也应该体现为是尊重依个人意志所作出的选择，即被追诉人可以选择如实供述、说谎、沉默，认为尊重个人选择就是尊重个人尊严。“反对自证其罪的权利”已经成为一项国际准则。联合国《公民权利和政治权利的国际公约》第十四条第三项确认：“不被强迫作不利于他自己的证言或强迫承认犯罪”。联合国大会1985年11月29日通过的《联合国少年司法最低限度标准规则》（《北京规则》）还宣告：根据正当法律程序，保持沉默的权利是“公平合理审判”所应包括的基本保障之一。应当看到的是在这方面的价值选择上，以保护人权为理念的英美法系和以追求事实真相、惩治犯罪为目标的大陆法系是存在区别的。但是，英美法系的制度中也要求被告人在放弃沉默权后有如实供述的义务，而大陆法系的代表德国又规定了被追诉人有一定限制程度的说谎权。
