程志强，陕西淳化人，理论经济学博士，应用经济学博士后，北京大学光华管理学院兼职教授、博士后联合会主席，中国博士后科学基金会理事。长期从事区域经济、农村经济、企业管理等领域的研究，在《管理世界》等核心期刊上发表数十篇学位论文，独著、主编多部学术著作。

农业产业化项目，尤其是农业生产环节，是土地使用密集型的项目，因此，农地制度的安排包括农地的产权、使用权、收益权的设定以及农地的初始分配和流转状况，都可能会影响农户、龙头企业等参与农业产业化垂直协调的各方主体的交易成本，从而影响垂直协调的契约安排。同时，不同的契约安排，会对农地的产权、使用权、收益权的归属形成不同的要求，进而影响农地的流转状况。因此，农地制度以及农地流转在农业产业化垂直协调过程中发挥重要的作用。本节是理论部分的核心，我们首先简要回顾中华人民共和国成立后农地制度的变迁，然后结合中国的实际情况梳理农业产业化和农地流转之间相互影响和相互制约的关系。
3.4.1 新中国成立后农地制度的变迁
对于本书而言，在分析农地制度对农业产业化契约选择和发展的影响之前，对中国农地制度的变迁做一个简要的回顾，是非常必要的。这种独有的农地制度及其变迁深刻影响着农业产业化垂直协调过程中交易成本的形成和变化。总的来说，新中国成立后中国农地制度大致经历了土地改革、合作社、人民公社和家庭联产承包责任制这样四个时期。
新中国成立前中国实行的是以地主土地所有制为主体的土地产权制度，新中国成立后不久在中共中央七届三中全会上提出的《中华人民共和国土地改革法》（1950），废除了地主阶级封建剥削的土地所有制，实行农民的土地所有制。在这一土地改革时期，除了部分划归国有的土地之外，农地土地产权制度以农民土地所有制为基础，农民拥有包括土地的所有权、使用权和收益权在内的独立完整的土地产权（赵阳，2007）。
农民土地所有制在发展过程中很快出现了两极分化的现象，也难以满足重化工业优先发展战略下形成的高度计划体制的要求，1951年中央下发了《关于农业生产互助合作的决议》（草案），提出“简单的互助组”、“长年的互助组”和土地合作社（以土地入股为特点的农业生产合作社）。对于互助组而言，土地产权制度并没有发生本质性的变化，而在土地合作社中，农民依然占有土地所有权，但土地的使用权和收益权归合作社集体使用和分配，实际上，土地所有权在一定程度上被虚化了（赵阳，2007）。到1956年，全国参加农业生产合作社的农户达到96.3%，其中参加高级社的农户达到88%，中国农业合作化基本完成（田传浩，2005）。
