《海关法教程（第二版）》2009年出版至今已经六年了，当中国海关出版社的马超编辑打电话给我时，我真的倍觉惭愧。六年的时间，海关法律已经有了大量的更新和较大的发展，而这本充作教材的小书却还停留在原地！

终于，第三版的内容更新完了，忽然发现我自己已经落伍多时。各种法规规章的更新、颁布自不待言，就海关的监管模式或曰路径而言，“单一窗口”已经不再是纸面上的理论探讨，分类管理也已经不仅仅是把名称改为信用管理，中外海关关于AEO企业互认已经完成了韩、欧等国家和地区的谈判……

感谢我的两位“债权人”，中国海关出版社的马超编辑和胡佳辰编辑，除了和我讨论需要更新的内容和全书的逻辑脉络外，更重要的是督促我终于还上了这个欠了六年的“债”。当我写下这些絮叨的时候，我明白非常枯燥烦琐甚至痛苦的编辑工作正等着她们呢。因为我的随意，我竟然不敢保证书中的语言是否通顺、脚注的格式是否正确统一，只好辛苦两位“债权人”，请她们容忍我没有适当履行“债务”了。

本书是以充作教材为写作初衷的，但是对一些学术问题我又忍不住想发表一点看法，于是行文中会夹杂一些我的“私货”。为避免读者误认我的个人观点为学界共识或通说，我尽量在脚注中注明或者把我的观点放在脚注中，在此特向读者提前“申报”。好在这些私货也还算不是粗制滥造，至少当我翻看第二版的内容时我发现有不少那时候的私货与现在海关法规规章所体现的制度变革是不谋而合的。这也让我能够斗胆继续夹藏私货了。

我试图努力跟上海关法发展的步伐，但是海关法发展的深度和广度都是惊人的，限于时间、精力和资料的原因，只能先尽力把传统海关法的内容做好。因此本书的内容仍然是分成通关、征税、担保、知识产权海关保护、加工贸易、行邮、统计、稽查、缉私、法律救济几部分，在每一部分中适当增加诸如边境安全、风险管理等内容。当然，这些内容还是很不够，特别是

看到一些相关的新闻，我突然感到其实边境安全威胁离海关并不远，并坚定了在运输工具监管中增加美国海关集装箱安全倡议的内容不算无的放矢的想法。

让我自己稍感欣慰的是本书在海关事务担保和中外海关法律的比较方面还算做了一些有益的探索。海关事务担保是我博士论文的关注焦点，也是这六年中还能为自己辩解我没有中断海关法律学习研究的主要理由。也希望我对海关事务担保的这一点研究能够为我国相关制度的发展贡献一点点绵薄之力。就美国海关法在估价、原产地等方面的一些制度而言，与我国相关制度既有相通之处，也有值得我们研究借鉴的地方。我非常希望能够用更大的篇幅来讨论美国的估价和原产地制度，但是美国属于普通法系国家，其对问题的分析讨论大量使用的是普通法的思路和方法。要把这些法律完整地介绍给读者需要大量的判例，并且要就其论理进行详细的解析。作为一本关于中国海关法的书，显然在篇幅上难以做到。因此对美国海关估价、原产地规则的介绍只能是比较浅显的。如果本书的这一点点浅显介绍能够引起感兴趣的学者、学生更多的关注和研究，我想我的目的也就达到了。

随着“多哈回合”最后达成《贸易便利化协定》，新一轮便利贸易的举措正在酝酿中。从报章反映看，大家期待殷殷。而我们国家也推出了自由贸易实验区，各种便利贸易的改革设想都开始付诸实现。相信在不远的将来，更多的贸易便利化法律制度会陆续出台。而TPP协议的签署也会对知识产权海关保护的制度产生深远的影响。届时，我们的海关法想必又要做很多的改动，本书就又该更新了，希望那时我的两位“债权人”能够不必为实现“债权”而一等再等。对她们的耐心和鼓励，衷心地再次
